Terms & Conditions
These Terms & Conditions (the “Terms”) govern your access to and use of the websites, mobile applications, and other services published by Aman Prajapati (collectively, the “Services”). By installing, accessing, or using any of the Services you agree to be bound by these Terms. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Services. If you are under 18, you confirm that a parent or legal guardian has reviewed and accepted these Terms on your behalf.
2. Your account
- You are responsible for maintaining the confidentiality of your credentials.
- You are responsible for all activity that occurs under your account.
- You agree to provide accurate and current information and to update it as needed.
- We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to the Services or other users.
3. Licence to use the Services
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the Services for your personal, non-commercial use. We retain all rights, title, and interest in the Services, including all intellectual property rights.
4. Acceptable use
You agree not to:
- Use the Services for any unlawful, harmful, fraudulent, or abusive purpose.
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of any part of the Services, except to the extent permitted by applicable law.
- Interfere with the operation of the Services, including by introducing malware, denying service, or scraping at a scale that disrupts other users.
- Use the Services to upload content that infringes intellectual property, privacy, or publicity rights, or that is defamatory, obscene, hateful, or harassing.
- Bypass security or access controls, including rate limits, authentication, or licensing mechanisms.
- Resell, sublicense, or commercially exploit the Services without our written consent.
5. User content
You retain ownership of the content you create or upload. You grant us a worldwide, royalty-free, non-exclusive licence to host, store, process, transmit, and display your content solely to operate and improve the Services. You are solely responsible for your content and confirm that you have all necessary rights to share it.
6. Purchases & subscriptions
Some Services may offer paid features, in-app purchases, or subscriptions billed through the Google Play Store or another platform. All purchases are subject to the policies of the platform processing the transaction. Unless required by law, all payments are non-refundable. You may manage and cancel subscriptions in your platform account settings.
7. Updates & availability
We may release updates, patches, or new versions of the Services from time to time. Some updates may be applied automatically. We may add, remove, or modify features without notice. The Services are provided on an as-available basis and may experience downtime.
8. Third-party services
The Services may link to or interoperate with third-party services (for example, Google Sign-In, Firebase, AdMob, payment processors). Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services.
9. Intellectual property
All trademarks, logos, names, and content (other than your user content) are owned by us or our licensors. Nothing in these Terms transfers any ownership rights to you. If you believe content in the Services infringes your intellectual property, please contact us at amanprajapati832@gmail.com.
10. Disclaimers
The Services are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free, or that defects will be corrected.
11. Limitation of liability
To the maximum extent permitted by law, we (and our affiliates, officers, employees, and agents) will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Services. Our total aggregate liability for any claim arising from these Terms or the Services will not exceed INR 5,000 (or the equivalent in your local currency) or the amount you paid us, if any, in the twelve months preceding the claim — whichever is greater.
12. Indemnity
You agree to defend, indemnify, and hold harmless Aman Prajapati from and against any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Services, your content, or your breach of these Terms.
13. Termination
You may stop using the Services at any time. We may suspend or terminate your access at any time if you violate these Terms or if we discontinue the Services. Sections that by their nature should survive termination will survive — including ownership, disclaimers, limitation of liability, and dispute resolution.
14. Governing law & disputes
These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any dispute will be subject to the exclusive jurisdiction of the courts located in Indore, Madhya Pradesh, India, except where applicable consumer protection law gives you the right to bring proceedings in your country of residence.
15. Changes to these Terms
We may update these Terms from time to time. If we make material changes we will notify you (for example, by posting a notice in the Services or sending an email). Continued use of the Services after the changes take effect constitutes acceptance of the updated Terms.
